New York, The Pen is Mightier than the Sword!

"Any person owning, possessing or harboring a wild animal or reptile capable
of inflicting bodily harm upon a human being is guilty of a CLASS E FELONY AS DEFINED BY THE PENAL LAW."

Without action, the above quote will be made law in New York State. Yes, even the smallest of reptiles have teeth and are capable of bodily harm. As currently written, it effectively bans ALL reptiles. Due to the size of my collection, this law would instantly make me a felon 30 times over.

The proposed bill, A2869, is currently in the NYS Agriculture Committee for review. Below is a list I've complied with the names and contact information of EVERY assembly member on that committee. Please take a few minutes to help me oppose this reckless and overbearing legislation. Write a polite but firm letter explaining your opposition. Do not be rude. Do not be vulgar. And for the love of God, proof read it (or give it to someone who's good at writing to proof read it for you). Then print out 46 copies and send 2 letters to each of the 23 committee members (one to their Albany office, and one to their district office). If their email address is listed, send a copy electronically too. Herper's of NY, make your voices heard!

Im not sure if this is being taken out of context or not what does the rest of it say? becuse im sure if any reptile could cause harm and it was a felony they couldnt sell them in pet stores. I feel like they might just be talking about like "real" wild animals and venomous reptiles. I know when I was living in CT they passed something that people couldnt own Dart Frogs because they were poisoness but once it was proved that they werent it was overturned

George, you've just quoted the reptiles section of the Wild Animals definition that's already on the books.  This new proposed bill states "wild animals and reptiles," meaning everything on the wild animal list + anything that is a reptile.  This effectively supercedes the reptiles on the wild animal list with a blanket ban on all reptiles.  It is, without doubt, the most poorly written piece of bacon I've ever read.

e.  "Wild  animal"  shall not include "companion animal" as defined in


  section three hundred fifty of the agriculture  and  markets  law.  Wild


  animal  includes,  and is limited to, any or all of the following orders


  and families:

    (2) Felidae and all hybrids thereof, with the exception of the species


  Felis catus (domesticated and feral cats, which shall mean  domesticated

Anyway feel free to correct me if I'm reading something wrong. But from the way I'm putting this together, the wording in the proposed bill "IS  DEFINED  IN ACCORDANCE TO PARAGRAPH E OF SUBDIVISION SIX OF SECTION 11-0103" would mean this:


(6) Crocodylia.


I'm not reading this as "all" reptiles.


But I am quite hungover. And Sonja will corect me if I'm wrong.

George, the term "WILD ANIMAL" is defined in accordance to paragraph e of subdivision six of section 11-0103.  But the bill doesn't prohibit just the possession of WILD ANIMALS.  It clearly states that it prohibits the possession of wild animals (as defined) AND REPTILES.  This wording makes it such that everything on the list you quoted is included,  PLUS anything that falls under the category of REPTILE.
