§ 29.1-582. Forfeiture and disposition of animals possessed in violation of this article.

A. Law-enforcement and animal control officers shall, upon probable cause, impound any or all animals possessed in violation of this article. If such animal poses an immediate threat to public safety or is suffering from apparent animal neglect or cruelty, the animal shall be seized by law-enforcement or animal control officers and held in a suitable federal, state, or local facility or other facility exempted from this article in § 29.1-579 until judicial determination of forfeiture.

B. Upon seizing or impounding an animal, the law-enforcement or animal control officer shall petition the general district court in the city or county where the animal is seized or impounded for a hearing. D. Any animal judicially deemed forfeited pursuant to this article shall as soon as practicable be euthanized by a licensed veterinarian or humanely destroyed as recommended by a licensed veterinarian unless (i) a person legally able to possess the animal and willing and able to take immediate possession of the animal is identified prior to or at the forfeiture hearing, in which case the court may award such person ownership of the animal, or (ii) the court determines that the animal is listed in 50 C.F.R. 17.11 as protected under the Endangered Species Act (16 U.S.C. § 1531 et seq.), in which case such animal shall be ceded to the U.S. Fish and Wildlife Service.

E. A court may order the owner of an animal seized pursuant to this article to post a bond in surety with the locality for the cost of caring for such animal for a period of time not to exceed nine months. If the court orders the posting of a bond in surety, the bond shall be posted with the clerk of the court within five business days after the hearing. If the person ordered to post the bond does not do so, the animal is deemed forfeited.

§ 29.1-583. Voluntary relinquishment.

Nothing in this article shall be construed to prevent the voluntary, permanent relinquishment of any animal by its owner to a person legally able to possess the animal and willing and able to take possession or have such animal euthanized by a licensed veterinarian in lieu of seizure or impoundment. Voluntary relinquishment shall have no effect on any criminal charges that may be pursued by the appropriate authorities concerning possession or treatment of the animal.

A meeting, regarding Virginia’s proposed SB 477 is set for Tuesday, at 11:00, this allows for everyone to get their animals tended to, children on the school bus, business meetings to be rescheduled, etc... Please bring your lunch or a snack as I am sure this will take some time. This is open to everyone. So if you see someone's name not on the Cc please forward this email.

There is a lot to go over including the bill Delegate Peace is presenting. Very similar but quite different then the one Senator Lucas #477. You must remember that this does not only affects us but the industry as a whole, such as private breeders and pet stores, in addition to the general public. Please invite your local pet store owners, etc.. Please take the time to invite your local Delegate and Senator, they are all in Richmond right now.

We need someone to step up to the plate as door greeters for name tags and sign in sheet. Plus we need someone for the secretary duty, any volunteers. Volunteers are needed for clean up afterward.

RSVP please to bearpathacres@aol.com, Sorry but high speed Internet is not one of those things that is available in my area, so Cc everybody at one time is impossible. We need to get an approximate head count for name tags.

Remember this is not a witch hunt, this is a meeting of the great minds of Virginia. Put your thinking cap on and leave your punching bags at home!

So mark your calenders and we will see on Tuesday at 11:00.

Yes we now have two Bills. The first Bill was introduced to the Virginia Senate on January 11, 2012 and is known as Senate Bill NO. 477 or SB 477.
http://lis.virginia.gov/cgi-bin/legp604.exe?121+ful+SB477
The second Bill was introduced to the Virginia House of Delegates on January 20, 2012 and is known as House Bill NO. 1242 or HB 1242.
http://lis.virginia.gov/cgi-bin/legp604.exe?121+ful+HB1242
Both Bills are very similar with HB 1242 adding more species.

Yes, we will have some big guns in attendance.

I'll keep you up to date.

Larry that runs HDG, Richmond, and Manassas?  From MD Reptile Farm?  Just making sure I know who we're talking about.  I'm doing everything I can right now to get off work, I think there was some time off available that day.

David Means,
Posted At: 1/21/2012 6:30:29 PM

Yes, Larry from Maryland Reptile Farm.

The meeting I posted above is not the hearing, it's a meeting of exotic keepers to organize and discus how best to fight these Bills. If you plan on attending the meeting please email Debbie at bearpathacres@aol.com to RSVP. She needs to know how many are coming.

Tiki108,
Posted At: 1/21/2012 6:44:54 PM

Oh ok, well as soon as I know whether I can get off or not I'll email her.

Emily Milton,

Good Lord - we're 22 days into January... is this the year of all politicians saying, "Ok, let's not worry about education, crime, unemployment, job creation or our national defense, let's find a BRAND NEW direction to go - let's ban all snakes everywhere!  No one's done that yet!"

WTF.  Seriously.  /sigh

Peter Jolles,
Posted At: 1/22/2012 11:06:36 AM
Don't they have anything better to do?

Brett Nation,
Posted At: 1/22/2012 12:52:33 PM

NEW PROPOSED VIRGINIA LAW IS DISCRIMINATION!

POSSIBLE CLASS ACTION LAWSUIT ON A NATIONAL LEVEL?

See definition of Herpetology on Wikipedia here >>> http://en.wikipedia.org/wiki/Herpetology

Because these bills are unprecedented bans on snakes they discriminate against our children as far as less education opportunities and advancement and career opportunities. They also discriminate against responsible, hard working adults because they will no longer be able to compete for business on a National Level, not to mention an interantional.

Brett Nation,
Posted At: 1/22/2012 12:58:56 PM

FROM NOTE ABOVE:

There has been NO economic study in VIrginia relating to these bans posted.

Does it exist?

Brett Nation,

Captive-Bred Reptiles Are Domesticated

Herpetology is the branch of zoology concerned with the study of amphibians (including frogs, toads, salamanders, newts, and gymnophiona) and reptiles (including snakes, lizards, amphisbaenids, turtles, terrapins, tortoises, crocodilians, and the tuataras). People with an avid interest in herpetology and who keep different reptiles or amphibians often refer to themselves as “herpers”. Herpteculture is the captive care and breeding of reptiles and amphibians.

Many people have kept snakes as loving family pets in their homes with great success and the first Reptile House was established during 1847 in London. During January 2012, the US Government acknowledged the annual sell and trade of high-quality captive-bred reptiles is a $1.6 to 3 billion industry today. Because captive breeding programs for snakes have been established well over 50 years now, Herpteculture provides a legitimate source of business and family income. In fact, there are many domestic snakes available to purchase in local Pet Stores for at least and Reptile Expos today.

Snakes are 100% dependant on humans to survive in captivity (especially captive-bred snakes). To successfully keep ANY type of snakes as pets they will need specific husbandry to surive, including: humidity, temperature and lighting as well as proper enclosures to make the animal feel safe and secure. Although there is no scientific evidence to support that snakes are capable of emotions, most captive-bred animals will recongnize their keepers/owners as a source of food and snakes respond well to feeding schedules because this is the only life they know.

Most domestic reptiles in captivity---including snakes that are kept as loving family pets---are tame and will most often tolerate proper handling because they trust and respect their keepers (humans) to survive. Many snakes can also be selectrively-bred to ensure specific color morphs or hybrids to increase their value because they are not found in nature. These can lead to increased demand and higher profits to breeders. However, this also means they would be highly vulnerable to any other domestic or natural predators should they escape captivity and most likely they would perish in the wild.

Brett Nation,
Posted At: 1/22/2012 2:13:34 PM

OK, I need to do a few minor edits and will print up some letters.Any constructive feedback welcome!

Perhaps I am the first to claim snake are domestic animals, but I sincerely doubt I will be the last to do so by simple definition of "domestic". My snakes were born in captivity and I love my family pets!

Cheers!

One more thought....Virginia does not protect its native wildlife with this bill. Need to do more research of protected reptiles.

http://www.vaherps.com/t1019-update-sb477-meeting-other-important-info#9575

Here's some more info about Tuesday's Meeting in Richmond regarding SB477. I was asked to pass this new info along to anyone interested.

From Debbie Jeter:

I am meeting with a Democratic Stratagist today, she is going to go over everything we need to do to beat these bills. I am told we may have a special guest appearance also. I will share what I was told at Tuesday's meeting.

The 2 things that I know already:

1. You need to send hard copy letters to each Delegate and Senator, yes, 140. I guess they want us to support the postal service. I will have their address on Tuesday, if you need them.

2. They want an emergency plan. What would you do if an animal escaped? So start thing and writing it on paper.
This will probably be the last email from me until we meet on Tuesday. Today is booked with meetings and Monday is booked trying to put the meeting on paper.

So, I hope to see you all on Tuesday!

No one has stepped up to the plate to help with the administrative duties. Someone needs to speak up and help!

Have a great day!

I know Virginia has a similar license to Maryland when it comes to keeping native species, but as for protecting them, aside from that license, I don't know all the details.

I'm finishing up my letter and I should be able to send them out Monday, not looking forward to buying all those stamps though, lol.  I really hope I can attend Tuesday, still working on getting off.

Ok I got off work I'll see you guys there tomorrow.

Tiki108,
Posted At: 1/23/2012 10:40:59 AM

Ok got all the emails out, I sent them one by one and put the senator's name to make it not seem like a general email and make it a little more personal.

Emily Milton,
Posted At: 1/23/2012 10:58:29 AM

David -- superb research.  If it's slow at work today, I'll craft a letter (thanks for the actual bill - that'll help a lot!) and send it off to everyone I can.  North Carolina has your back!

Emily Milton,
Posted At: 1/23/2012 11:08:38 AM

Oh, one more question for you - it was mentioned above that the addresses for all these people will be coming Tuesday.  Is that still on?  I don't mind sending a ton of letters.  Truly.  This really is the year of, "Hey!  Let's screw over the economy even more by shutting down small businesses and taking away pets that people truly adore - forget our national defense, it'll be fine."

Tiki108,
Posted At: 1/23/2012 12:26:27 PM

I believe it is, I emailed Debbie to let her know I was coming and she said she'd see me tomorrow.  I emailed my letter, but I'm going to draw up a different one after I sit through the meeting and hear everyone's thoughts tomorrow.

pidak reptiles,

David Means,

Yes boas will be banned if this passes.

Brett Nation,

didn't read all the way through this thread, but if it hasn't already been posted, here's the senate version:

SB477

i know USARK has been in VA meeting with legislators about this, but i'm not sure what all has been talked about or who andrew has met with.

Hard, hard times for us Virginians. We are doing all we can to stop this..

David Means,

Everyone!!! Please help me get the word out about these proposed Bills. Email/call Virginia breeders, pet stores, exotic keepers, and anyone else these proposed Bills will impact. Copy the info above and post it in forums and on facebook, anywhere that will help make people aware this is going on. You would be surprised how many people I've talked to that have no idea about these Bills.

Thanks, David

I've been posting and re-posting till I can't post anymore..there is a meeting at Pet Paradise in Va Beach tonight at 7pm for anyone who would like to attend. Not exactly sure what to expect, but hopefully we can all work together and come up with helpful ideas to put an end to this!

Emily Milton,
Posted At: 1/23/2012 4:31:57 PM

I don't live in Virginia, but I had a thought.  I would imagine a good deal of the reptile trade happens on Craig's List - it's just easy.  That being said, do you think you could make a new post under the pet thread (or however they do it for Virginia) about what's going on?

You're totally right, I'm sure half the people out there who are lovers of herps have  NO CLUE about this.  Sticking it right with the sale of these creatures would definitely get the word out if people look at it.

David Means,
Posted At: 1/23/2012 4:35:46 PM

The posts on Craig's List have been getting flagged as soon as they go up, or the HSUS lovers start posting about how these bans are a good thing.

Emily Milton,
Posted At: 1/23/2012 4:38:42 PM

WOW - seriously?  I had no idea, it just seemed like a good way to get the word out.  Ooops.

I suppose at the moment we rely on sites like iHerp and Fauna (among many others) to get the word out.  I wonder how much a cheap ad in a newspaper would be.  Something indie, not like the official city's newspaper, but a cooler one that goes around for free (and people actually read)

David Means,
Posted At: 1/23/2012 4:41:22 PM

Great idea!!! I'll look into it. Thanks

We had a decent turn out at the Exotic Animal Keepers meeting in Richmond today with some big names in the herp community showing up. Michael Maddox of PIJAC attended the meeting and offered a wealth of great information on how to proceed with our efforts. The whole meeting was very informative and everyone had valuable input.

We need to proceed as a community and take action that will be effective in getting these proposed Bills withdrawn. The following points are listed in order of what was determined to be the most effective approach to reaching our goal.

  • The number one best thing you can do is: EVERYTHING listed below.

  •  make an appointment with Delegate Christopher K Peace (patron who introduced HB 1242)

General Assembly Building
P.O. Box 406
Richmond, Virginia 23218
Phone: (804) 698-1097
Fax: (804) 698-6797
Email: DelCPeace@house.virginia.gov
Room Number: 527

And

Senator L. Louise Lucas (patron who introduced SB 477)

Senate of Virginia
P.O. Box 396
Richmond, VA 23218
Email: district18@senate.virginia.gov
Phone: (804) 698-7518
Fax: (804) 698-7651
Room No: 426

With a hand written letter in hand.

  • Also very effective is: make an appointment to meet with each member of the committee with a hand written letter addressed to each committee member in hand. Be sure to be polite and well dressed. Even if the person you are meeting with doesn’t agree with what you have to say, be sure to stay calm and represent the herp  community in a positive manner.

  • Ask friends, family, and co-workers to join you and spend a few hours in Richmond and lobby against both bills. It’s best to make appointments, but if time doesn’t allow for appointments or you are not able to get an appointment with any, than stop in each office and speak with members staff. Again with letters in hand.

  • Write letters (hand written letters carry the most weight) to each member on each committee, Delegate Christopher K Peace, and Senator L. Louise Lucas.  Letters should be in your own words and no more than one page. Letters don’t need to be long, a short and to the point letter is fine. Be sure you check your spelling, be respectful and polite.  If you are typing your letter be sure to hand sign them. Mailing and hand delivering letters will hold more weight than emailing or faxing them. Try to avoid form letters as they carry little to no weight. Using form letters as a guide to writing your letters in fine, but be sure your letter is in your own words so it appears more personal.

  • Make phone calls to each member on each committee, Delegate Christopher K Peace, and Senator L. Louise Lucas.

  • Petitions carry little to no weight.

Our first goal is to get Delegate Christopher K Peace, and Senator L. Louise to retract their proposed Bills before the committees meet to hear them. It is very important to set appointments and get letters out as soon as possible. If we don’t meet our first goal then the next goal is to have the proposed Bills dismissed by the committees or convince them to send the proposed Bills to scientific study (scientific study would buy us a year). To achieve this we need as many people as possible to be ready to show up at the public hearing with little notice (the hearing dates and time are only posted 24-48 hours before the hearing). We have people who are prepared to speak, but still need bodies to show our numbers as a community.

                                  Things to keep in mind

When you meet with Senators and Delegates be prepared to include escape protocols (they what to know what we would do in the event of a escape).

Be sure to back up any claims you make with facts that you can prove.

Be professional in every possible way. We want them to view our community as professional and responsible.

Even if you don’t own any species on these proposed Bills, get involved now. Just because the species you keep isn’t on the proposed Bills now, doesn’t mean they can’t be added if these Bills get passed. Many other states passed bans that only started with a few species, but now are adding new species every year.

When communicating (in letters or person) with the Senators and Delegates about these proposed Bills, let them know that you opposed to the proposed Bills as they are written, but would be open to a reasonable permit process. This shows we as a community are responsible, reasonable and willing to work on a solution.

Lastly we all need to come together as a community and support each other. Don’t sit back and hope everyone else will fight this. We all need to do our part.

Tiki108,

Thanks for posting the info David, it was a great meeting!  I don't know if I'll be able to make it on Thursday to help lobby, but just incase anyone does want to help lobby they are meeting at 7am at the same location to carpool.

I think one thing that people need to remember is we need to unite.  My boyfriend and I were talking about this and he suggested this image:

I know it's for the states uniting, but as exotic keepers and even non-exotic keepers, we need to unite and support each other!

David Means,

Geat meeting you today. I glad you were able to make it.

Brett Nation,

@ David + 1 = Thanks again for organizing this meeting. I am so glad we have PIJAC involved with this.

@ Tiki + I =  Definitely glad you guys like the old flag idea. As I mentioned last week it has some interesting meaning:

Its time to go back to our roots and put up the good fight!

Was adopting the bald eagle as the national symbol a mistake? Should it have been the rattlesnake? Philosophically, the only flag in our history that reflects the cause of the American Revolution, which was a bloody fight for freedom, is the coiled rattlesnake over the words: DON'T TREAD ON ME!

The rattlesnake was the favorite animal emblem of the Americans even before the Revolution. In 1751, Benjamin Franklin's Pennsylvania Gazette carried a bitter article protesting the British practice of sending convicts to America. The author suggested that the colonists return the favor by shipping "a cargo of rattlesnakes, which could be distributed in St. James Park, Spring Garden, and other places of pleasure, and particularly in the noblemen's gardens." Three years later the same paper printed the picture (as seen below) of a snake as a commentary on the Albany Congress. To remind the delegates of the danger of disunity, the serpent was shown cut to pieces. Each segment is marked with the name of a colony, and the motto "Join or Die" below. Other newspapers took up the snake theme.

As you can see we need to fight as one!

NOTES: After rethinking over the image it could be threatening and politicians may know the history.... Thoughts?

Tiki108,
Posted At: 1/25/2012 8:30:27 AM

Well they could, but it doesn't seem to bother anyone that the tea party took the rattlesnake.  I think this is more for us, no one is going to be going around with these flags, it's not saying the states need to unite it's the reptile and other exotic animal communities, as well as non-exotic communities that need to ban together.

A silly mental health break on another way to get the word out:  Some chick who needed an organ transplant sent a Tweet to Justin Bieber in the hopes of a re-tweet.  He did.  And DAMN, did girl get some monetary donation help!

So um... is anyone here a Justin Bieber fan?  He has 16 million followers.  One tweet from him could skyrocket our campaign.

Tiki108,
Posted At: 1/25/2012 8:40:47 AM

Considering he had a boa, that's not a bad idea.  I'm not a fan and I don't have a twitter account, but I'm sure someone who has a twitter account could send him a tweet.  So who here has a twitter account?  I may get one just for this.

David Means,

Here is and update on our trip to Richmond to lobby against HB 1242 and SB 477. We only had a dozen people show up. Very disappointing considering the HSUS and ASPCA were there in full force with three times as many people. We met with a few delegates and aides, some meetings were positive while others not so much. Most hadn’t even read the Bill. If we are going keep our rights to own these animals, we are going to have to step it up people. I know people have jobs, but so do the people that showed up to lobby for our rights,. If we want to win this fight, sacrifices need to be made. I took my 12 year old daughter out of school so she could learn how our government works. I was surprised at how interested the delegates and aides were in my daughters feelings on the Bills. At times they seemed more interested in what she had to say than us adults. I encourage everyone to take a day off early next week and go to the Capital with your children (if you have any) and lobby against these Bills. Once the Bills get passed, it will be too late to do anything. The time to do something is now. Get letters out, have your children write letters as well. If these Bills pass we’ll lose our rights to keep these animals in Virginia forever. I really don’t think most people understand what really is at stake here. People could lose pets, breeding stock, jobs, and businesses. There are still many keepers that have no idea about what is going on so we need to get the word out.

Via USARK:

VA HB1242 Hits Legislative Deadline in Agriculture Sub-Committee. May be held over to 2013, but NOT GOING ANYWHERE in 2012! Kudos to all those in VA who have worked against it!! Today USARK CEO Andrew Wyatt learned from contacts in the VA General Assembly that Delegate Peace will pull HB1242 and possibly hold it over until 2013. This was confirmed by two separate sources.

SB477 is still alive, but will have a more difficult path to follow w/o it's House counterpart. A group of citizens and USARK members opposed to the bill will lobby door to door on Thursday February 2nd. If you would like to join this group email president@usark.org. There Is Strength In Numbers... Protect Your Rights!

+1 Shannon

I just got off the phone with Andrew Wyatt and this information is correct! Andrew said:  "This is NOT a victory, but we are off to a good start!"

We still need to fight SB477 on all fronts, so keep focused everyone!

There are still more battles to come for other states. Be ready to take action!

To all exotic animal keepers in Virginia:

This post may come across as a bit harsh, but it needs to be said. There are too many people in this community riding the coat tails of those working hard to fight the two bills in the Virginia House and Senate. We have people from Maryland and North Carolina driving to Virginia to support us in the fight for our rights to own these animals, yet we can only get a handful of Virginias’ to lobby against these bills.

I’ve been unemployed of eight months and had to decline the only chance I’d had for employment since I lost my job in order to fight these bills. I’ve spent money I don’t have on paper, envelopes, ink, fuel, and copies to get the letters sent to me in the hands of each delegate and senator on the committees hearing these bills. I do this because I’m passionate about working with the animals I keep and I don’t want to lose the right to work with them. I understand all to well the sacrifices that need to be made in order to prevail in this fight. We have people driving 4 ½ hours one way to lobby, people closing their business and turning away costumers and clients in order to be able to come to Richmond to fight this legislation. The time to fight is now, not after the bill become law.

I want to thank everyone who has made sacrifices to help in the fight for our rights to own the animals we keep and love. I look forward to seeing you all again this Thursday

We’ll be in Richmond this Thursday (February 2, 2012) to Lobby against SB 477. We need more than just 12 people to show up this time, we really need to make an impression. Remember the HSUS and other animal extremists are lobbying in great numbers showing their support of these Bills. We need to show Virginia's legislators our true numbers.

We will be meeting at:

Discovery UMC
13000 Gayton Road
Richmond, Va. 23233

Please be there before 8am, as we'll be departing for the General Assembly Building at 8:00.

Letter from Jared Watts

I would like to thank everyone for the push we have had here in the Virginia Reptile and Exotics Community in the last 2 weeks. Our response can show our legislators that prohibitions that have and still fail in neighboring states have no base here in the commonwealth. I, along with various others from the reptile and exotics community have been working diligently in gaining access to, and conversing with our delegates in Richmond. Currently both Bills 477 and 1242 remain on shakey ground (I dont trust politicians, so nothings dead until its buried) and this Thursday 2/2/2012 we will need massive representation from my fellow Virginians at the General Assembly building meeting and speaking to our various represenative’s while countering the PAID OPPOSITION the HSUS and PETA like organizations had in place blanketing the building with their propoganda against our community. I can't stress this enough, these delegates appreciate faces alot more than letters and works. They seem responsive to the private communities imput. WE ARE A COMMONWEALTH, IF WE CONTINUE TO PUSH THESE LAWS WILL NEVER GET IN THE DOOR HERE> I Urge everyone who has every and currently owned a reptile to show up one Thursday at the same church in Richmond at:
UMC
13000 Gayton Rd
Richmond,VA 23233
BETWEEN 7-8 AM after 8 We will already all be heading to the capitol feel free to meet us there.
I urge Everyone to Carpool. There are groups Meeting at my house (which is in Smithfield on Rt 10) as Well as Eric Crabtrees home in Norfolk VA. If YOU NEED A RIDE, or would like to carpool PLEASE EMAIL OR CALL ME DIRECTLY and we will make sure you get to Richmond with us. Carpooling is a must as parking is very limited and you may need money for tolls and parking per day is 15-20$ per vehicle. BRING COMFORTABLE SHOES! And please DRESS APPROPRIATELY. If I can get my Grizzly adams face into a suit then I know we all can show up looking to impress our legislators with our poise, knowledge, and unity as private facility owners and keepers here in Virginia. We currently have a minimum of 4 Meetings Currently set up between senators and legal aids and the first one begins at 9:00am. I MUST AGAIN STATE, THESE BILLS HAVE NOT DIED< AND THEY CAN STILL VERY MUCH EFFECT OUR RIGHTS THIS YEAR> WE MUST STAY DILIGENT AND NOT DROP OUR GUARD> THEY WILL BE BACK. BUT LETS HIT THEM SO HARD THIS THURSDAY THAT THE IMPRESSION RESOUNDS IN THERE MINDS EVERYTIME SOMEONE MENTIONS EXOTIC ANIMAL LEGISLATION IN VIRGINIA!
I EXPECT the community to be strong this week, and show up for something we all have a stake in. Dont let National organizations like the HSUS destroy our rights here at home!

Emily Milton,

Ok... there is NOTHING going on at the office today.  NOTHING.  A retired Judge even joined the firm and still, NOTHING is going on.

Well, there's a ton of addresses up there, and I have some nice printer paper and a postage machine.  Time to make things happen.

Emily Milton,
Posted At: 2/2/2012 5:36:35 PM

I got the two people who started the bill initially (Peace and Lucas) and then the 7 other people that were going over it since you mentioned it had moved.  As promised, nine letters went in the mail today.  Sorry I'm slow, but I get there!  A whole lot of nothing continued to happen at the office, so I focused on pythons.

Tiki108,

Emily, we were going on

We lobbyed today and it was awesome, we need more people!

David Means,

I'll give an update soon, it's been a long day and I need rest. I will say this...I had a blast today!!! We had some great people show up today and we all had fun. It's nice to meet new people and while having fun fighting for our rights. Thank you to all those who took time out of their busy day to come to Richmond.

Tiki108,
Posted At: 2/3/2012 12:02:43 AM

Ok ready for this one.  I got home and my phone ran, but I didn't recognize the number, let it go to voicemail and it was some guy saying he needed to inspect my collection and see what kind of animals I have.  It says right on my license that I keep only 1 native species, corn snakes.  The guy said, I'd like to meet with you sometime this week, I work 4pm-12am.  They never needed to do an inspect last year, my concern is if this guy is legit?  I'm going to listen to his message again tomorrow and call my state.  If he is I think it's from handing out my card today while lobbying.  It says on my card that I breed corn snakes, ball pythons, and carpet pythons.  I'm worried that when they see no carpets they'll think I'm hiding something, but I just decided to quit working with that species and sold all of them, but I didn't feel like printing new cards.

I have nothing to hide and will gladly show them my collection, but I'm a little upset that VA would call MD about me, what's their beef.  I never said I kept venomous or any of the animals on the bill, I said I opposed it!  It's just aggitating cause with my luck they'll come in and someone will have pooped or knocked a water bowl over or something.  I am fine with an inspection, but it does make me feel really uncomfortable...

Also, sometime this week, as in tomorrow?  Maybe I'm busy???  I don't want to delay him at all, but I'm just really concerned about why this has happened now, but not last year.

Smart Snakes Chad,
Posted At: 2/3/2012 1:50:45 AM

Based on recent experiences Tiki, I would not allow ANY government official to "inspect" my collection again without a warrant. The hell I went through starting this past summer and that I'm still dealing with now has made me reluctant to voluntarily cooperate with any goverment agencies. I had a snake confiscated and eventually euthanized because our local ACO literally made up a story that the species was dangerously venomous. NYS DEC then said they had the authority to declare an animal "venomous by nature" on the spot with no oversight, thus making it a violation to posses the animal even though said animal was not regulated in any way prior to the moment the officer said it was. I was ticketed and fined. The snake in question was never on any list of regulated species in NY. The DEC later claimed that it edned up testing positive for a parasite while in their care, so they euthanized it. I have a good friend who has venomous permits and has kept venomous reptiles confiscated by the state on many occasions over the past 10-15 years and still does. In all the time he has done this, no confiscated animals in his care or the care of other similar keepers working with the DEC had ever been tested by anyone for any reason. That just tells me they either wanted the matter resolved before I had my right to trial over the tickets, so they manufactured a story that the snake had a problem, or they screwed up horribly in the keeping of this animal and it died, so they tried to cover it up. But then, I could be just way too paranoid about governments subverting our rights.

If you aren't violating any laws or regulations, I wouldn't let anyone set foot in your home to see anything. These inspections appear to be a means to get access to people's animals to try to find a way to manufacture some unreasonable case to confiscate them in my opinion. The ACO here went so far as to give a specific source for her claim that my snake was dangerous. I investigated her claim thouroughly, and the source she gave didn't even exist, yet she still got away with it and no one cared that she lied. She even went so far as to later refer to the animal as "the one we thought was venomous". I fear I may be ranting, so I'll shut up now and stop hijacking this post. My snakes are now being housed on the grounds of a Catholic Church facility, so hopefully people will be a bit less likely to harrass me about them for the time being. And I'm trying to find a way to make this a much more permanent arrangement.

I really don’t think it had anything to do with lobbying in Richmond yesterday. What is more likely is that someone form the NPR thread googeled your user name and found your number on your website then turned you in or is just trying to scare you. If they are from the Maryland DNR they will have your address on the permit, so do give your address over the phone. I is possible someone was able to fine your address online somewhere as well, so be sure if someone shows up at your door they have the proper ID. You should call the Maryland DNR and see if it was really them that call you. I have some buddies in Maryland that keep corn, so if you need me to call them and see if they have ever had any problems, I’d be happy to do so.

@Tiki:

What ELSE does it say on your license?  What does it say about inspections, if anything?  If you have any other paperwork or permits, what do THEY say about inspections?  Is it like a landlord/tenant relationship where the landlord has the right to enter the premises anytime they wish?  Does the inspection have to be from a specific agency?  Or are inspections not even mentioned?

If inspections aren't mentioned on any valid, current legal document you have, tell the guy to go hug a root.

David, that is very possible, people don't like that they are wrong, lol.  I have nothing to hide my animals are all very well cared for, but it's just inconvient, I did call DNR and they are looking into it, which I don't think sounds suspious especially since I don't know who this guy is, but they are going to try and get back with my today if he's legit or not.

Emily, I have to pull up my terms, I'll still let him in, I'm not trying to hide anything, it's just annoying, but I'll make a comment to those people that I passed my inspection cause I have nothing to hide, try again!  Lol

According tothe Maryland Law you have to allow access for an inspection. If they do show up record names and job classifications, and I'd video tape the entire process.

Yeah, I have no issue with an inspection, but the video tape would be a great idea.

Ok, just so everyone knows the guy came over, was super nice and said they all look great.  I asked him if someone called and he said no that around this time of year they look to see who they have never done inspections for, since I got my permit last year after this time is why I didn't have one last year.  I thought about saying, well I guess I owe HSUS an apology, then I realized just how stupid that sounded, lol
